The popular brand name EXAM360 is registered under Intellectual Property India as per the Trade Marks Act, 1999.  

EXAM360 (INDIA) websites include its primary domain www.exam360.in and its affiliated subdomains like - https://shop.exam360.in/. These Website Terms and Conditions govern your use of the website. By using the Site, you agree to fully comply with these Terms and Conditions.  


TERMS OF USE  

1. You, (the “User”), can access https://shop.exam360.in/ and its associated platforms (collectively referred to as the “Site”), subject to the terms and conditions of use, as modified or updated from time to time at the sole discretion of EXAM360 (India) (“We/Us/Company”), as outlined below (“Terms of Use / User Terms of Use”). This Agreement is for an indefinite term, and by using the Site, you agree to be bound by these terms.

Updates to the Terms of Use applicable to the main domain and subdomains will take effect immediately upon being displayed prominently on the website.

EXAM360 does not guarantee that the website will operate error-free or that its third-party-hosted servers are free of computer viruses, server downtime, or other harmful mechanisms. If your use of this website or the content therein results in the need for replacement or repair of any equipment, hardware, or data, EXAM360 is not responsible for any such losses or damages.

It is your ("Users'") responsibility to periodically review the rules, guidelines, policies, terms, and conditions for any updates or changes. Your continued use of the website or Android application following the posting of updates or changes signifies your acceptance of and agreement to the revisions.

As long as you comply with the provisions of this Agreement, we grant you a personal, non-exclusive, non-transferable, and limited privilege to access and use the website.

3. ACCOUNT REGISTRATION & FEES:

I. User Responsibility and Confidentiality - 
By using the 'EXAM360 (INDIA) Website' as a Registered User, you are responsible for maintaining the confidentiality of your User ID, Password, and other related details. Similarly, as a Guest User, you must ensure the confidentiality of your Email ID and Phone Number, as well as restrict unauthorized access to your mobile, computer, system, and network.

You are liable for all activities that occur under your registered credentials or email and phone details as applicable. Additionally, Guest Users must ensure the physical security of the device used to access the website.

Required Information:
  • Registered Users: Must provide accurate details in the "New Users Registration" form.
  • Guest Users: Must provide updated contact details (Email ID, Mobile Number, Address, etc.).
If you suspect unauthorized access, fraudulent activities, or a breach of your account, immediately contact EXAM360 (INDIA) via email or helpline for assistance.

Consequences of Incorrect Information - 
If the details provided are found to be incorrect, false, incomplete, or not updated, EXAM360 (INDIA) reserves the right to suspend, block, or terminate your access or membership. EXAM360 (INDIA) shall not be liable for any damages resulting from non-compliance with these terms.

II. Registration and Fees - 
Registration on any 'EXAM360 (INDIA) Website' is free for all users. As an intermediary under the Information Technology Act, 2000, EXAM360 (INDIA) does not charge fees for browsing the website.

However, before adding items to your cart or making purchases, review the Charges, Fees, and Policies carefully. These are incorporated into this agreement by reference.

EXAM360 (INDIA) offers a unique buying experience on its official store (https://shop.exam360.in) where users can purchase printed books for competitive exams without the need for registration, User ID, or Password.

3. Policy Updates - 
EXAM360 (INDIA) reserves the right to modify its Charges, Fees, and Policy Standards at any time. Updated policies will be posted on the website and become effective immediately. Users are advised to review the policies periodically. Continued use of the website constitutes acceptance of any changes.

Payment of Fees and Taxes:
Users are responsible for paying all applicable charges, fees, taxes, and cesses associated with using the website, as per prevailing laws and government regulations.

Failure to pay applicable charges may result in suspension or termination of access. Legal actions may also be pursued against violators.

5. Rights Reserved - 
EXAM360 (INDIA) reserves the right to:
  • Suspend, block, or terminate access for non-compliance with payment or policy standards.
  • Modify charges, policies, or standards as deemed necessary.
  • Take legal action against users violating policy standards. 
5. USE OF WEBSITE:
I. General Understanding - 
By using the EXAM360 (INDIA) website, you agree that EXAM360 (INDIA) provides third-party hosting services to its users.

  • EXAM360 (INDIA) does not manufacture all the books listed on its site, except those published under EXAM360 PUBLICATION.
  • The listed items are based on their cover page or content. EXAM360 (INDIA) is not liable for any reliance on such data/content/products.

III. Liability - 
  • EXAM360 (INDIA) does not guarantee the accuracy of content and is not responsible for losses resulting from errors or reliance on such content.
  • If you encounter unethical transactions or any breach of the User Agreement, report them via email at 'info@exam360.in' or 'exam360.in@gmail.com'.

IV. Marketing and Communications - 
EXAM360 (INDIA) may use your information for marketing, promotions, emails, calls, or other modes of communication, as outlined in the User Agreement and Privacy Policy.

V. User Eligibility - 
  • Minors below 18 years or individuals incapable of entering a contract are not permitted to use this website.

VI. Pricing and Payment -

  • All payments must be in Indian Rupees.
  • Before shipping, supporting documents (e.g., ID proof) may be required to ensure a safe shopping experience.

VII. Shipping and Delivery - 
  • Delivery is facilitated through third-party courier services. Delays caused by courier companies are not the responsibility of EXAM360 (INDIA).
  • Buyers are advised to verify shipping charges, which cover shipping, packaging, and other processing fees.
  • Orders cannot be cancelled, exchanged, returned, or refunded once placed.
  • Wrong or incomplete address details will result in delivery delays. Corrections may be addressed within 30 working days, but refunds will not be issued.

VIII. Refunds and Returns - 
  • Refunds/replacements for hard-copy products may take up to 7 working days. Refunds will not apply to digital products or delays caused by courier partners.
  • Buyers must inspect product packaging upon delivery. Any tampering should be reported within two days.

IX. Errors and Liabilities - 
  • EXAM360 (INDIA) is not liable for errors in non-EXAM360 PUBLICATION books.
  • Errors in EXAM360 PUBLICATION books will be corrected in subsequent editions upon notification.

X. Third-Party Services - 
  • External links and third-party services are not managed by EXAM360 (INDIA). Users should review their privacy policies.

XI. Restrictions on Usage - 
  • Users are prohibited from data mining, advertising, and using the website in violation of laws or to harm others.

XII. Cookie Usage -

7. BULK ORDER PROCESSING:
This section is divided into two segments:
  • D2C (Direct to Customers)
  • D2B (Direct to Business)

D2C (Direct to Customers):
The pricing of items displayed on the 'EXAM360 (INDIA) Websites' is intended for B2C (Business to Customer) purchases only. Items will be delivered through third-party logistics partners.

D2B (Direct to Business):
This segment is applicable for select "Users" who place bulk orders. In such cases, users are required to pay the total bill amount, which includes transport charges.

We are gradually expanding our distribution and supply chain network across India, including drop-shipping services. Bulk orders are typically dispatched through Railway Mail Services (RMS) or other transportation options based on the user’s preferences.

10. PRICING: 
The pricing of books listed on EXAM360 (INDIA) Website or Android App is primarily designed for general D2C (Direct-to-Customer) sales. Prices may vary depending on the sales channel, availability, market conditions, publisher revisions, and other applicable factors. Before placing an order through our website or Android application, users/buyers are requested to carefully review the product details, displayed price, applicable policies, Terms & Conditions, and other relevant information.

Price Verification by QC Team - After an order is placed, it may be forwarded to our dedicated Quality Control (QC) Team for verification. During the verification process, the QC Team may compare the displayed website price with the currently available physical stock and its applicable pricing. In case of any pricing discrepancy, revision, or variation, the order may require additional verification or appropriate action. Price variations may generally arise in the following situations:

1) Higher Printed MRP: If the MRP printed on the currently available physical book is higher than the price displayed on our website or application.

2) Publisher Price Revision (Either Catalogue or Printed MRP. Change or Updated / Discount Slabs Change): If the publisher has revised the price, discount, edition, or other pricing-related details of books currently available in stock.

3) Market Shortage or Supply Crisis: If the product is facing a shortage, limited availability, supply disruption, or an exceptional market situation resulting in an increase in procurement or market prices.

Cancellation requests, refunds, replacements, or exchanges arising solely due to changes in general market prices after the purchase may be subject to the applicable Terms & Conditions and return/refund policies of EXAM360 (INDIA).

11. OFFERS & DISCOUNTS:
Offers and discounts (if available) will be explicitly displayed on the 'EXAM360 (INDIA).' No additional discounts or offers will be provided for D2C (Direct-to-Customer) transactions.

For D2B (Direct-to-Business) customers, additional benefits such as offers, discounts, or cash discounts on bulk purchases may be available. B2B customers are encouraged to contact the Offline Sales Team for the best pricing options.

12. ORDER CANCELLATION POLICY:

A. On-Demand Request (Item not shipped/transit):
EXAM360 allows "Order Cancellation" under specific conditions after 24 hours, with a maximum penalty of 10% of the total amount or Rs. 50/-, whichever is higher. If the item has not been shipped or is not in transit from the EXAM360 warehouse. Customers can request order cancellation by contacting support team through ECG PORTAL.

B. Fulfilment Issues (Item not shipped/transit):
EXAM360 does not impose any cancellation penalty when a product that was displayed as “In Stock” at the time of purchase is not shipped, dispatched, or moved to in-transit status within 30 business days from the date of the order. Public holidays and other applicable non-business days are excluded from this calculation. If the product remains unshipped and has not entered transit after the above-mentioned period, the customer may request cancellation of the order. Important Exclusions - This policy is not applicable to: ➥ Pre-Booking Products, ➥ Stock on Demand Products, ➥ Orders that have already been shipped or dispatched and are currently in transit

Once an order has been shipped and is in transit, it will not be covered under this provision. 

Full Refund Eligibility - 
If, for any reason as mentioned in this points, a product was displayed as “In Stock” at the time of placing the order, but the product has not been shipped or has not entered transit within the applicable period, EXAM360 will be liable to issue a full refund without any cancellation penalty, deduction, or additional charge, subject to the terms of this policy.

How to Request a Refund - 
Customers may contact our dedicated support team through the ECG Portal for further information regarding the refund process: https://support.exam360.in/. Alternatively, customers may submit a refund request directly through the Order Status Portal: https://orders.exam360.in/

Please note that the Self Refund Request feature will become available in the Order Status Portal only after 25 days from the date of the order. Before the completion of 25 days, the system will not allow customers to generate a self-service refund request through the portal. For further assistance regarding refund collection or eligibility, customers are requested to contact the dedicated support team through the ECG Portal.

C. Priority Request (Order by Mistake):
EXAM360 permits "Order Cancellation" for customers who mistakenly order the wrong item. A charges of 5% of the total amount (including shipping charges) or Rs. 30/-, whichever is higher, will apply if the request is made within 24 hours of placing the order through ECG PORTAL. Beyond 24 hours, the cancellation will follow the terms under Point 12. A.

Note: Before placing an order, ensure you select the correct product and quantity. Any disputes arising after placing an order or making payment may result in penalties. Customers are advised not to make payments unless they agree with the policies.

D. Order Cancellation by EXAM360 (Item not in transit / returned to the warehouse):
EXAM360 reserves the right to cancel orders under the following circumstances, with a maximum penalty of 20% of the total amount (including shipping charges) or Rs. 100/-, whichever is higher:
  1. Refusal of delivery by the customer.
  2. Incorrect or insufficient delivery information provided.
  3. Violation or abuse of EXAM360's policies or platform terms.
Important Note:
  • No "Order Cancellation" requests will be accepted if the item is shipped.
  • Delays caused by delivery partners do not qualify for cancellation.
  • The "Order Cancellation" policy is for fair use only. Misuse or abuse of this policy will invoke penalties as per Point 12. A.
  • Customers must submit written requests promptly via email at exam360.in@gmail.com for any order-related issues.

13. INDEMNITY:
By using the 'EXAM360 (INDIA) Websites' you agree to indemnify EXAM360, its parent company, subsidiaries, suppliers, third-party contributors, and their respective employees, officers, and agents from any losses, liabilities, damages, costs, or claims arising from materials submitted by you and/or your use of the website content, including source code and software.

EXAM360 (INDIA) shall not be liable for any losses or damages arising directly or indirectly from your use of the website. The content and information provided are governed by the laws of India, and the courts of India will have jurisdiction. All disputes under this agreement shall fall under the jurisdiction of Kolkata.

14. TRANSACTIONS:
'EXAM360 (INDIA) Websites' utilize third-party payment gateways, including Paytm, Instamojo, PayPal, and PayUmoney, to process payments based on customer preferences. EXAM360 is not responsible for delays in payment processing, incorrect transaction execution, or order cancellations due to settlement delays.

While EXAM360 will assist customers in resolving payment-related issues, it does not guarantee resolution due to limited control over third-party payment gateways. EXAM360 will not be held liable for any losses or damages resulting from errors or delays caused by payment service providers.

15. ACCURACY & AUTHENTICITY:

Unaccredited use of our property may violate copyright, trademark and other applicable laws, and You shall be liable for criminal and/or civil penalties for the same. You are granted a non-exclusive, non-transferable, limited right to access the site and avail the services provided by EXAM360.

EXAM360 (INDIA) may share personal information with OUR other entities only for marketing & other purpose. These entities may market to you as a result of such sharing of information, unless you explicitly opt-out.

EXAM360 (INDIA) may disclose personal information to third parties. This disclosure may be required by us to provide You with the access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose Your personal information to third parties for their marketing and advertising purposes without Your explicit consent.

EXAM360 (INDIA) may disclose personal information if required to do so under the law or in good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.

EXAM360 (INDIA) will share some or all of Your personal information with another business entity we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of the business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this privacy policy with respect to Your personal information.

EXAM360 (INDIA) reserve the rights to block , terminate or suspend users account with or without any notice for false, incomplete claim or misleading information and may initiate legal actions as per the Law & Order against the users who files an invalid, false claim or provides false, incomplete, or misleading information.

Any person who, wants to claim Fraud Complains containing false, incomplete or misleading information or any fraudulent activities with EXAM360 (INDIA) shall be guilty of a criminal and will be prosecuted to the fullest extent under the law.

20. GRIEVANCE:
Users who want to disapprove any contents, products or find any errors, difficulties on EXAM360 (INDIA) are requested to give your feedback through ECG PORTAL. We assure our users that we will take necessary steps to improve.

21. GENERAL DISPUTE ON ORDERS:
In our experience we saw some common disputes arises from "Users" ends which are as follows:
1. Return / Refund request for not getting delivery on time due to service delay.
2. Product received is different from what is placed.
3. Product received is in damaged condition.
4. Error in contents of the product.
5. Error in Item Quantity.
6. Refuse shipment during delivery. 

Here are the related solutions or services which will be provided by us for better "Users" experience:

1. 'Return / Refund request for not getting delivery on time': We operate through third party logistics service provider like FEDEX Courier, Delhivery, Gati, Trackon Courier, India Post etc. On booking of the items we provide our customers the attached tracking id of respective companies to our customers and users are requested to track the product items in the official websites of these respective courier companies. If any delay occurred due to logistic courier companies we may-not be responsible for it but if users request us to follow-up the case in PRIORITY wise, definitely we will follow-up your case & will try our best to arrange the delivery at the earliest. In case if users need to get refund in such cases, we may issues partial refund with Penalty (Refer to "Point 12. A" & "Penalty" ) depends on the return product conditions.

2.'Product received is different from what is placed': In this type of problems we have only one advice for our customers that on receiving the product, if different product is received please make a short video's and take multiple photo's  for strong evidence and connect our support team through ECG PORTAL within 24 - 48 hours for replacement.

The EXAM360 internal team will review the evidence provided and may accept or decline your return request based on the case details. However, in certain situations, the buyer may need to ship the product themselves due to the unavailability of a Reverse Pick-Up Facility.

We generally encourage our customers to use India Post for returning products, as their rates are significantly lower compared to other service providers. Customers will be responsible for the shipping costs and must send the payment receipt and tracking slip to us through ECG PORTAL.

Once we receive the product in excellent condition, we will process a replacement or refund the amount within 0–7 days. Refunds or replacements will only be initiated upon fulfilment of the above conditions..

3.'Product received is in damaged condition': If the product is received in damaged condition "Users" are requested to take short video's and take multiple photo's of the damaged product and send it to our support team  through ECG PORTAL. In this type of problem there are several factors involved like product mishandling by 3rd party courier service providers, mishandling by customer and placing fake return request so this kind of request need special enquiry and this special enquiry will be fulfilled by our "Investigation" department and this may takes 0-7 days (Excluding Holiday) or more upon receiving the product in return from "Users". For shipment of the product from customer to us please go through the processes mentioned in 'POINT NO:2'.

4.'Error in contents of the product': In these cases buyers are requested to contact the publishers of the books except in the case of our in house publication i.e. EXAM360 PUBLICATION. We will not accept return replacement, exchange or refund in these types of cases and it is strongly advised from our side please go through the terms and conditions before making any such type of request as well as purchase.

5. 'Error in Product Quantity': In these cases if an item is missing, "Users" need to contact us directly through Helpline number or through ECG PORTAL. EXAM360 dedicated support team will investigate the case immediately with in 0-3 days (Excluding Holiday) or more. After validation of the case we may resend the missing item if found the error was done by EXAM360 Team. 

6. 'Refuse shipment during delivery': If this type of condition occur, direct penalty of Max. 20% or In such cases, we request "Users" to respect our policy and not to place any orders until you agreed with the policies.

As these errors are very rare i.e. below 1%. In such type of cases we will re-send the item again without any further charges from "Users". But No Refund / Replacement (Other Products) will be entertained in this cases only.

22. SHORTAGE / EXCESS DEMAND:
Shortage / Excess Demand refers to a situation where the demand for a particular product exceeds its available supply. During such situations, certain products sold through EXAM360 may be subject to the following terms and conditions:

1. Return, Replacement & Cancellation - During a declared Shortage / Excess Demand situation, special processing conditions may apply to the affected products. Customers are advised to review the product availability and applicable processing timelines before placing an order. Return, replacement, cancellation, or refund eligibility may be subject to the specific terms applicable to the product and the actual stage of order processing.

2. Priority in Order Processing - During a shortage or excess demand situation, EXAM360 may process orders serially based on standard order requests and operational availability. However, Prime Members and customers who have paid an additional amount for Expedite Delivery may be given additional processing priority, subject to product availability. Please note that priority processing does not guarantee immediate product availability if the product is physically unavailable from suppliers or the market.

3. Processing Time During Shortage - During a shortage of supply, order processing may take up to 30 days, depending upon the real-time availability of the product.

Please Note:
A. The processing period does not include the delivery or transit time.
B. The actual timeline may vary depending on supplier availability, market conditions, and other circumstances affecting product procurement.
C. If you have paid for Expedite Delivery, your shipment may receive faster delivery priority after the order has been successfully processed and shipped, subject to the applicable delivery service.

4. Product Displayed as "In Stock" but Physically Unavailable - In certain situations, a product may have been displayed as “In Stock” at the time of purchase, but may subsequently be found to be physically unavailable. This situation may arise when the inventory system indicates available stock, but the physically available products:

⚫ Have been completely damaged;
⚫ Have become unsuitable for sale;
⚫Have been removed from usable inventory;
⚫ Have been moved to scrap or disposal; or
⚫ Are otherwise physically unavailable due to inventory discrepancies.

In such circumstances, EXAM360 may require additional time to arrange or procure the product. Customers may be requested to wait for the applicable processing period, which may extend up to 30 days or longer depending upon real-time market and supply conditions.

5. Additional Amount for Stock-on-Demand Processing - During a shortage situation, EXAM360 may, where applicable, offer customers the option to arrange or process a product through special procurement or stock-on-demand arrangements. In such cases, customers may be requested to pay an additional amount for arranging the product. Any additional payment must be made only through the official payment methods approved by EXAM360: https://support.exam360.in/payment

No payment made through any un-official payment method, personal account, or unauthorized channel will be accepted or recognized by EXAM360.

6. Refund Where the Order Cannot Be Fulfilled - If EXAM360 is unable to fulfill or process an eligible order within the applicable 30-day processing timeline, subject to the specific product category and applicable terms, the customer may request cancellation and a refund. Where a refund is applicable, the customer may raise a refund request through the designated EXAM360 support channels or refund system. Please note that products classified as Pre-Booking, Stock on Demand, or products subject to separately disclosed special conditions may have different cancellation and refund terms.

7. No Liability for Consequential Losses or Damages - EXAM360 will make reasonable efforts to arrange and fulfill customer orders during periods of shortage or excess demand. However, delays caused by product shortages, supplier unavailability, market conditions, inventory discrepancies, damaged stock, procurement difficulties, or other circumstances affecting product availability may occur. In such cases, EXAM360 shall not be responsible for indirect or consequential losses or damages claimed by customers solely due to the processing delay. This includes claims alleging, for example:

⚫ That unnecessary time was consumed;
⚫ That payment remained held during the processing period;
⚫ That the customer suffered an opportunity loss due to the delay; or
⚫ Any similar consequential claim arising solely from the delay in product processing.

Nothing in this policy is intended to restrict any refund or other rights that may be applicable to customers under mandatory consumer protection laws.

8. Our Commitment to Customers - EXAM360 always makes its best possible efforts to ful-fill customer requests and arrange books and educational materials, even during periods of market crisis, unexpected shortages, or excessive demand. We request customers to maintain reasonable cooperation and understanding where genuine product availability issues arise.

Customers who are unwilling to accept the applicable processing timelines, availability conditions, and shortage-related terms are advised to carefully consider these conditions before placing an order through our website. Our objective is always to ful-fill genuine customer requirements with a positive approach. However, cooperation and reasonable understanding from both EXAM360 and the customer are essential during exceptional shortage or supply-crisis situations. 
ALERT: Be aware from fraud calls / e-mails. EXAM360 doesn't demand any extra Payments Request in any other accounts / Links except the above given links. If you suspect any frauds please report us immediately using the through ECG PORTAL.

23. ADRESS CHANGE REQUEST POLICY:
If an order has not yet been shipped or dispatched and the customer needs to change the delivery location or address, the customer may request an address update before the order is dispatched.

How to Request an Address Change - If the order is still under processing and EXAM360 is preparing the item for shipment, please contact our support team as soon as possible through any of the following official channels:

While contacting the support team, customers should clearly mention their Order ID and provide the new/correct delivery address. Important: Request Before Dispatch. Address-change requests can only be considered before the item is dispatched. Once the item has been dispatched/shipped, there is no provision to make any further changes to the delivery address through EXAM360.

Therefore, customers are strongly advised to verify their delivery address before placing an order and, if any change becomes necessary, contact the support team before dispatch. 

Please Note: Submitting an address-change request does not automatically guarantee that the address will be updated. The request is subject to the actual processing and dispatch status of the order at the time the request is received.

24. OTHERS:
All products sold at EXAM360 are 100% original & authentic. However while purchasing any products we request users to go through the product IMAGE properly instead of the Title, Description, User's comments, Etc. The Title, Description or User's comments may not be the same as per the content or cover page of the books.  Also we request to go through the Language properly using the cover image of the books before checkout. All Products sold at offer's will not be eligible for any type of Return / Replacement / Refund.

25. PRICE UPWARD / DOWNWARD:
Price fluctuations are upward or downward swings in the prices of products in an economy. If any order is booked and customer wants to cancel the order for such causes. EXAM360™ (INDIA) reserves the rights not to cancel such orders due to price fluctuations.
